Expedia’s “Fly Fantasy” Giveaway Official Rules

No Purchase Necessary. A Purchase Will Not Increase Your Chances of Winning.

Information on how to enter, the prizes and rules for redeeming the prizes form part of the terms and conditions of entry for the Expedia “Fly Fantasy” Giveaway (“Giveaway”). Participation in the Giveaway is deemed to be acceptance of these official rules (“Official Rules”) and any other notices referenced herein.

In these Official Rules, the term “you” refers to any person who enters, or who wishes to enter, the Giveaway.

1. This Giveaway is organized by Expedia Asia Pacific Limited (Hong Kong Travel Licence No. 353750) (the “Sponsor”).
2. Eligibility: Expedia’s “Fly Fantasy” Giveaway is open only to legal residents of Hong Kong who are at least eighteen (18) years old at time of entry. Employees of the Sponsor and its parent companies, subsidiaries, affiliates, retailers, distributors, officers, directors, employees, contractors, governors, related entities, partners, partnerships, principals, agents, attorneys, insurers, licensees, sponsors, representatives, shareholders, successors and assigns, and advertising/promotion agencies, as well as the immediate family (spouse, parents, siblings, and children) and/or household members of those employees, are not eligible to enter or to win.
3. Agreement to Official Rules: By entering, you indicate your full and unconditional agreement to (a) these Official Rules and (b) Sponsor’s decisions, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
4. Giveaway Period: The Giveaway has three entry periods as set out in the following chart (each, an “Entry Period” and combined, “the Giveaway Period”). For greater certainty and the avoidance of doubt, entries submitted and received during any given Entry Period will not be carried over into any subsequent Entry Period(s). Sponsor’s computer is the official time-keeping device for the Giveaway.

5. How to Enter: NO PURCHASE NECESSARY. To enter the Giveaway, a participant must, during an Entry Period, complete the following:

Step 1: Visit the Expedia “Fly Fantasy” Giveaway campaign posts on expedia_hk Instagram.

Step 2: Tag 3 people that the participant would like to travel with.

Step 3: Answer in the comment section where the participant believes the destination is based on clues from the video, and explain in less than 50 words if the participant wishes to go to that destination and why.

All entries must be submitted through the Giveaway campaign posts on expedia_hk Instagram. Each participant is allowed one (1) entry per Entry Period. If a participant submits more than one (1) entry per Entry Period, only the earliest entry received will be considered, and the rest will be voided. Each participant may only use one Instagram account to enter the Giveaway. Each participant is not permitted to enter the Giveaway in multiple Instagram accounts, additional submissions will not be acknowledged. Sponsor may remove entries without notice for any reason whatsoever, including any entries that violate these Official Rules. Each participant may not win more than one (1) prize during the Giveaway Period. If a participant wins a prize, all further entries by that participant are voided. If a participant wins but has his/her prize forfeited for whatever reason, he/she is not eligible to win again and all further entries by that participant will be voided. Participation is subject to these Official Rules. When you enter, you are providing information to Sponsor.

Your submitted entry must be your original work and must not plagiarize others’ content or entry. Any incorrect or incomplete information submitted will result in the disqualification of the entry for the Giveaway.

Entries must not contain anything determined by the Sponsor in its sole discretion to be:

1. unlawful, inappropriate, harmful, offensive, abusive, racist, religious, political, violent, profanity or hate speech; or
2. obscene, pornographic, sexually explicit, discriminatory or defamatory; or
3. in breach of applicable law or infringe the rights of any third party.

Any entry that does not comply with these Official Rules is void and will not be entered into the Giveaway.

6. Selection of Winners: Winning entry(ies) will be selected by a panel of judges selected by the Sponsor. Potential winners will be selected from eligible entries that correctly identify the travel destination in the campaign post, based on the creativity and originality of their entry. If none of the entries for an Entry Period correctly identifies the travel destination in the Giveaway campaign post on expedia_hk Instagram, no prize will be awarded for that Entry Period. Unawarded prize(s) will not roll over to the next Entry Period.

7. Notification and Requirements of Potential Winners: Potential winners will be notified via Instagram direct message provided in their entry. Once notified that you are a potential winner, you will be required to respond to the Instagram direct message within forty-eight (48) hours to accept your prize. If a potential winner notification remains unanswered for more than forty-eight (48) hours, the prize will be forfeited in its entirety and an alternate winner will be selected. Potential winners will be required to execute and return to Sponsor an affidavit of eligibility, a liability release and, where lawful, a publicity release within ten (10) days of date of issuance. If documents are not returned within the specified time period, prize notification is returned as undeliverable, Sponsor is unable to contact a potential winner or a potential winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor’s discretion, an alternate potential winner may be selected by selecting the next most original and creative entry that correctly identifies the travel destination in the campaign post, from among all remaining eligible entries received during the relevant Entry Period.

8. Prizes: There are six (6) prizes (each, a “Prize”) available to be won as identified in the chart above. The ranking and exact Prize will be assigned by the Sponsor to each potential winner in the Sponsor’s sole discretion. Potential winners are not allowed to choose the Prize and no request or challenge will be entertained.

Winners will receive prize redemption instructions over Instagram direct message. The Expedia Rewards Points will be deposited into a winner’s account within six weeks after winner acceptance of Prize and will expire eighteen (18) months from the date of the deposit. If a winner is not an Expedia Rewards program member, he/she will need to create an account prior to a prize being awarded Rewards program points (deposited digitally directly into your Expedia Rewards account). Rewards Points awarded to the winner are subject to terms and conditions of the Expedia Rewards program.

A winner is responsible for paying any applicable federal, state, provincial, local, income and withholding taxes, if any. In the event that any tax withholding is required by law for the prize, a winner authorizes Sponsor to make the corresponding deduction.  Any prize details not specified above will be determined by Sponsor, in its sole discretion.  Sponsor will not be liable for any fees incurred as a consequence of changing or cancelling reservations. Sponsor will not replace any lost or stolen prizes or prize components. A Winner may not transfer, assign, or substitute the prize, or redeem the prize for cash, except at the sole discretion of the Sponsor, who reserves the right to substitute the prize (or portion thereof) with one of comparable or greater value.  Prize is awarded “as is” without any warranty or guarantee, either express or implied by Sponsor. It is the responsibility of the winners and travel companions to check the advisories issued by the government and to comply with all applicable legal and regulatory requirements and the policies and requirements of the relevant travel service provider including healthy and safety guidelines.

9. General Conditions: In the event that the operation, security, or administration of the Giveaway is impaired in any way, including, but not limited to fraud, virus, or other technical problem, Sponsor may, in its sole discretion, either: (a) suspend the Giveaway to address the impairment and then resume the Giveaway in a manner that best conforms to the spirit of these Official Rules; or (b) terminate the Giveaway and may elect not to award any prize or to award the prizes from among the valid entries submitted up to the time of termination. Sponsor has the right to modify the prize award rules. Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor. In the event of a dispute as to the owner of an entry, the authorized Instagram account holder used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person who is assigned to an Instagram account. The Giveaway is subject to applicable laws and regulations and is void where prohibited.

10. Release and Limitations of Liability: By participating in the Giveaway , you agree to release and hold harmless Sponsor, its subsidiaries, affiliates, and their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Giveaway; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Giveaway or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway or receipt or use of any prize. You further agree that in any cause of action, in no event shall the Released Parties be liable for attorney’s fees. 11. Collection and Use of Your Personal Information: Expedia may collect and process your personal information directly or through our agents or contractors. We will use your personal information as necessary in order to conduct and manage the Giveaway, and, where we have a lawful basis to do so, to send marketing communications to you. We may disclose your personal information to our related companies, agents, and contractors to assist in conducting and managing this offer, communicating with you, or storing data. This may include disclosures to organizations outside Hong Kong in places such as the United States.

12. Disputes: You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the Hong Kong SAR. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of the Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the Hong Kong SAR.

13. Results: Winners will be announced as comments under the campaign post on Expedia’s Instagram page.

14. The Sponsor reserves the right to vary, postpone, re-schedule and/or extend the Giveaway Period and any Entry Period(s) at its sole discretion without prior notice. The Sponsor reserves the right to at any time, change, amend, delete or add to these Official Rules at any time without prior notice.

15. Should there be any discrepancy between the English and Chinese version of these Official Rules, the English version shall prevail.
